General Terms and Conditions
PREAMBLE
These "General Terms and Conditions of Sale" apply to legal transactions concerning products sold by Sarl LPVJ to its customers through its online store.
DEFINITIONS:
The words or expressions below will have the following meaning in this document:
Online Store: refers to the Sarl LPVJ website where Products are presented and sold to customers.
Order: refers to the sales contract concluded between Sarl LPVJ and the customer of Sarl LPVJ's online store.
Product Sheet: refers to the classified information concerning a product provided by Sarl LPVJ when the said product is put up for sale in its online store.
Products: refers to all goods and services offered for sale by Sarl LPVJ in its online store.
Service: refers to the sale of Products by Sarl LPVJ to the customers of its online store.
Transaction: refers to all operations, secure processing, authorizations, and agreements inherent to the payment of the price of the Products ordered by credit card.
ARTICLE 1 - PURPOSE
The purpose of these General Terms and Conditions of Sale is to define the terms and conditions under which Sarl LPVJ offers and sells its Products to its customers.
These general terms and conditions of sale shall prevail over all other conditions appearing in any other document, unless there is a prior, express, and written derogation.
ARTICLE 2 - ACCEPTANCE OF CONDITIONS
The customer acknowledges having read these general terms and conditions of sale at the time of placing the Order and expressly declares to accept them without reservation.
These general terms and conditions of sale govern the contractual relations between Sarl LPVJ and its customer, both parties accepting them without reservation.
ARTICLE 3 - PRODUCTS
The majority of products offered by Sarl LPVJ to its customers are immediately available.
However, not all products sold by Sarl LPVJ are necessarily available for online sale.
ARTICLE 4 - ORDER
Automatic registration systems are considered as proof of the nature, content, and date of the Order.
Sarl LPVJ will confirm the acceptance of the Order to the customer by sending a confirmation message to the email address provided by the customer. The sale will only be concluded upon sending of the said order confirmation.
Sarl LPVJ reserves the right to refuse or cancel any Order from a customer, particularly in the event of the said customer's insolvency or in the event of non-payment of the Order concerned or a previous delivery or a dispute relating to the payment of a previous order.
The information provided by the customer when entering the details inherent to their Order is binding. Sarl LPVJ cannot be held responsible for errors made by the customer in the wording of the recipient's contact details for the Order (delivery address, billing address in particular) and for delivery delays or the impossibility of delivering the ordered Products that these errors may cause.
ARTICLE 5 - DELIVERY
After confirmation of the Order and subject to full payment of the price of the ordered products, Sarl LPVJ undertakes to ship the ordered products to its customer at the delivery address within 2 to 10 days depending on the availability of the products (especially those not in stock and which depend on arrivals from the United Kingdom). We undertake to communicate the progress status to the customer by email or phone.
All Products stipulated in Orders placed with Sarl LPVJ are intended for the personal use of the customers or recipients whose name is mentioned at the delivery address.
If applicable, the customer undertakes to pay upon receipt all present and future taxes, duties, and other charges due for the delivery of the said products themselves; the joint and several liability of Sarl LPVJ cannot under any circumstances be invoked in this respect.
Customers or recipients of the Products are prohibited from any partial or total resale of the Products.
Delivery will be carried out by Colissimo via the post office, to your home or to a So Colissimo relay point (for France).
Our delivery rates are available in your account before order validation.
In the event of a delivery delay exceeding seven (7) days, the Customer may, if they wish, and except in cases of force majeure, terminate the sales contract by registered letter with acknowledgment of receipt. However, this right must be exercised within sixty (60) working days from the initially scheduled delivery date in the contract.
Upon receipt of the ordered Products, the customer or recipient must check the proper functioning of the delivered item and will read its conditions of use appearing in the user manual provided.
In the event that one or more of the ordered Products are missing or damaged, the customer or recipient must make any reservations with the carrier at the time of delivery.
In case of apparent defects, the customer benefits from the right of return under the conditions provided in the product's user manual.
Due to the availability of the ordered Products, an Order may be subject to several successive deliveries to the customer.
In the event that the customer wishes the ordered Products to be delivered to two different addresses, they should place 2 separate Orders.
ARTICLE 6 - RIGHT OF WITHDRAWAL
From the receipt of the ordered Products, the customer has a period of 60 days to return them to Sarl LPVJ for an exchange and a period of 30 days for a refund. In this case, the customer must return the new Products with labels, intact, accompanied by all possible accessories, user manuals, and documentation to the following address:

In the event of exercising the right of withdrawal, Sarl LPVJ undertakes to refund the sums paid by the customer, without charge, with the exception of return costs.
The refund is due within a maximum of 14 days from the receipt of the returned item.
ARTICLE 7 - PRICE
The price is expressed in euros.
The price indicated on the Product Sheets does not include transport costs.
The price indicated in the Order confirmation is the final price, expressed inclusive of all taxes and including VAT. This price includes the price of the Products, handling, packaging, and storage costs of the Products, transport, and commissioning costs.
ARTICLE 8 - PAYMENT
The price invoiced to the customer is the price indicated on the Order confirmation sent by Sarl LPVJ.
The price of the Products is payable in full by one of the payment methods offered on the site on the day of the actual order.
The Order validated by the customer will only be considered effective once the secure bank payment center has given its approval to the transaction and, if applicable, after acceptance of risk coverage by the insurer.
ARTICLE 9 - APPLICABLE LAW
These general terms and conditions of sale are subject to French law.
ARTICLE 10 - LIABILITY
Sarl LPVJ cannot be held responsible for damages of any kind, whether material, immaterial, or bodily, which could result from a malfunction or improper use of the marketed Products.
Sarl LPVJ's liability will, in any event, be limited to the amount of the order. In case of difficulties in the application of this contract, the customer and Sarl LPVJ reserve the possibility, before any legal action, to seek an amicable solution.
Failing this, for professional customers, the Commercial Court of Lille has sole jurisdiction, regardless of the place of delivery and the accepted payment method.
ARTICLE 11 - WARRANTY
In all cases, Sarl LPVJ cannot be held responsible for non-compliance with the regulatory and legislative provisions in force in the country of receipt. Sarl LPVJ's liability is systematically limited to the value of the Product in question determined on the date of its sale and this without any possibility of recourse against the brand or the manufacturing company of the product.

ARTICLE 12 - LEGAL INFORMATION
The provision of personal information collected for the purpose of distance selling is mandatory, as this information is essential for the processing and delivery of orders, the establishment of invoices, and warranty contracts. Failure to provide information will result in the non-validation of the Order.
In accordance with the "Informatique et Libertés" law, the processing of personal information relating to customers has been declared to the National Commission for Information Technology and Liberties (CNIL).
The customer has (Article 34 of the law of January 6, 1978) a right to access, modify, rectify, and delete data concerning them, which they can exercise with Store-Factory. Furthermore, Sarl LPVJ undertakes not to communicate, freely or for consideration, its customers' contact details to a third party.
